최근 중앙선거관리위원회(이하 선관위)에서는 ‘선거관련 트위터 이용 가능범위’에 대한 보도자료를 냈다.
여기서 선관위측은 “선거운동을 할 수 없는 19세미만의 자 등이 특정정당 또는 후보자를 지지․반대하는 내용을 게시하는 행위”를 금지했고, 또 예비후보자 외에 누구든지 정당 또는 입후보 예정자 등에 대한 지지․반대 등을 게시할 수 없다(선거운동기간 전)고 밝혔다.
이에 대해 선관위에 묻고 싶다. 과연 트위터에서 어떻게 19세 미만을 골라 낼 수 있는 것인가?
만약에 그런 방법이 있다고 하더라도 헌법이 보장한 사생활의 범위를 침범하지 않고
그것이 과연 가능할 수 있을지 의문이다.
또 트위터에서 예비후보자를 제외한 누구도 지지, 반대를 할 수 없다고 한 것도 선거법에서 보장한
“정당의 후보자 추천에 관한 단순한 지지·반대 의견개진 및 의사표시”(법 58조 제1항 3조)와 맞지 않는다.
