개발제한구역(그린벨트)은 사회주의국가 땅인가? 개발제한구역은 누구의 땅인가? 개발제한구역 내 사유지를 환경을 지킨다며 서울시민의 허파라고 보존해야 한다고 하다가 임대주택특법 등 통치법을 앞세워 자본주의 근간 을 무시하고 사회주의사회에서나 하는 식으로 마구 해제하여 풀어서 쓰고 있는 이런 몰지각한 정부(청와대 건교부 환경부)의 행태를 중단하시오.. 내곡지구국민임대주택 공람지구의경우 환경등급1.2,3등급이 98% 이다. 서민이 살 집이기 때문에 환경등급이 좋은 곳에 지어주려고 하는가? 내곡지구국민임대주택 공람지구 그 외에 개발제한구역도 보존해야 한다는 명분이 없으므로 정부가 개발제한구역으로 제한할 필요가 없을 것으로 본다. 남은 지역의 개발제한구역의 해제를 강력히 촉구한다. 임대주택특별법은 노무현정부에서 제정된 것으로 알고 있으며 이는 통치법수준으로 국민의 기본권인 재산권을 압살 말살하려는 의도가 있고 재산권을 탈취해가는 잘못된 법률이다. 금일현재까지 개발제한구역(그린벨트)은 정부가 99% 다 풀어서 쓴다. 일반국민이 해제한 면적은 미미하다 고로 개발제한구역의 농지 임야 관리는 지주가 하고 권리는 정부에 있다 고로 정부는 세금을 감면하던가 40여 년간 재산권행사를 제한을 전면 해제하기를 강력히 촉구한다. 자본주의사회에서 임대주택에 살 사람은 특혜를 주고 땅을 소유한 선량한 지주(세금 내고 그린벨트로 묶여 관리 잘하고 있는 지주)에겐 이처럼 재산권에 고통을 주는가? 땅을 가진 지주도 국민이고 임대주택에 살 사람도 국민이다 이는 헌법에 명시된 국민의 평등권에 위배되는 행태이다. 공공사업에 편입되는 농지 임야의 경우 양도소득세의 면제도 다시 더 연장해야 할 것이다. 지주는 팔고 싶지도 않은 땅을 약칭 임특법 특별법 등으로 수용 다하면서 세금을 다 받아가는 형태는 어느 나라 법인가? 임특법 특별법 등으로 공공용지로 편입되는 지주 대다수의 면적은 임대아파트에 살아야 할 정도의 소득밖에 안 되는 농업소득을 유지하며 납세의무와 개발제한구역 법에 순응하며 살아왔다 마지막으로 재산권까지 강탈해갈 것 인가? 참여정부의 임특법 같이 국민으로써 지주도 똑 같은 혜택을 받고 싶다. 현재는 선 지구지정하고 후 개발제한구역 해제함으로써 토지보상비를 줄이기 위해 법을 악용 하고 있다 시정하라. 개발제한구역을 선 해제 하고 후 지구지정 함으로써 국민의 재산권을 찾도록 정부(관련부서)는 정책을 바꿔라. 왜~무주택 서민에게는 국가가 관대한가? 환경부는 환경정책을 일관성 있게 집행하라. 어제까지는 개발제한구역을 보존해야 한다고 하고 이제는 임대주택특법으로 해제해야 한다니 개발제한구역의 사전 환경성 검토 협의를 통과시키려는 의도는 다분히 국민의 지탄을 받을 것이다. 어찌하여 임대주택특별법 앞에선 개발제한구역의 환경과 정책이 하루아침에 변할 수 있는 것 인가? 졸속적인 행정집행을 중단하고 백년대계를 생각하고 올바른 정책의 입안과 충분한 검증 검토를 통해서 정책을 수립하고 사업을 시행하라. 1. 개발제한구역을 보존하려면 임대주택도 짓지 말라 2. 임대주택 짓기 위해 개발제한구역을 해제하려면 남은 개발제한구역도 해제하라. 3. 임대주택특별법 외 각종특별법으로 개발제한구역을 해제하려면 선 개발제한구역해제 후 지구지정 하여 국민의 평등권인 재산권을 보장하라. 4. 정부(건교부 환경부)와 입법부는 개발제한구역 내 지주와 특별법으로 혜택을 받을 수혜자와 동등한 헌법의 기본권인 평등권이 지켜지게 하라.
